Councilman Hernandez Statement on Voting to Retain Legal Services

Start Date: April 12, 2013, 2:28 PM
End Date: April 12, 2013, 3:00 PM

District 1, City Councilman Victor Hernandez to vote in favor of The City of Lubbock retaining the legal services of an attorney to provide advice and counsel on three separate issues.

Councilman Hernandez stated, "As a result of City Manager Lee Ann Dumbauld and Executive Director of Finance Pam Moon hiring local Lubbock attorney Jim Hund to represent their interests, I think it incumbent for The City of Lubbock to "lawyer up" so as to represent The City of Lubbock's interest."

The scope of work for The City of Lubbock's outside counsel, and who is expected to be named quickly, is to provide legal representation on:

1. The city manager's employment status and options associated therewith;

2. The allegations asserted by Executive Director of Budget, Cheryl Brock, that the city manager directed her to file a complaint against Councilman Hernandez under threat of being fired; and

3. The allegations asserted by the city manager as against Councilman Victor Hernandez.

Councilman Hernandez continued, "The trigger which prompted me to have a change of position in the hiring of outside legal counsel is partly based upon the situation having become adversarial. Being an attorney myself, I am confident that with attorneys involved (on behalf of all parties), the possibility of open and honest communication is now available."
